Terms of Service

1. Acceptance of Terms

By accessing or using Monito (the "Service"), including the browser extension and web application at monito.dev, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Monito is operated by Monito ("we", "us", or "our"). These terms constitute a legally binding agreement between you and Monito.

2. Service Description

Monito is a browser debugging and bug reporting tool that consists of:

  • A browser extension that records debugging sessions by capturing network requests, user interactions, console logs, screenshots, and screen recordings
  • A web application for viewing, managing, and sharing recorded debug sessions

3. Account Registration and Eligibility

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Debug Session Data Collection and Consent

By using the Monito browser extension, you explicitly consent to the collection and storage of the following data during debug sessions:

  • Network Requests and Responses: Complete HTTP/HTTPS requests and responses, including headers, request bodies, response bodies, URLs, status codes, and timing information
  • WebSocket Communications: WebSocket message types and frame data
  • User Interactions: Click events, keypresses, form submissions, text selections, including DOM element selectors, coordinates, and values entered
  • Console Logs: All console output including logs, warnings, errors, and their severity levels
  • Screenshots: Visual captures of your browser window at specific points during debugging sessions
  • Screen Recordings: Video recordings of your browser session, including camera and screen capture
  • Navigation Events: URLs visited, page transitions, frame identifiers, and document identifiers
  • Device and Browser Information: User agent, browser name and version, operating system, device type, screen resolution, device pixel ratio, memory usage, network connection type, and available browser features

Important: Debug sessions may contain sensitive information including authentication tokens, API keys, personal data, form inputs, and proprietary business information. You are solely responsible for reviewing captured data before sharing sessions with others.

5. Public and Private Sessions

Debug sessions can be marked as either private or public. Private sessions are only accessible to you and members of your organization. Public sessions are accessible to anyone with the session link.

You are responsible for ensuring that public sessions do not contain confidential, sensitive, or proprietary information. We are not liable for any unauthorized access to or disclosure of information in public sessions.

6. Team and Organization Features

If you create an organization or join a team, you agree that all members of that organization may access debug sessions created by any member, unless explicitly restricted.

Organization administrators have the ability to manage members, view all sessions, and control organization settings. By joining an organization, you consent to this data sharing.

7. Acceptable Use

You agree not to:

  • Use the Service to capture, store, or share data from websites or applications without proper authorization
  • Violate any applicable laws, regulations, or third-party rights, including privacy rights, intellectual property rights, or terms of service of other websites
  • Upload or transmit viruses, malware, or any malicious code through the Service
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
  • Use the Service to harass, abuse, or harm another person or entity
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service without our prior written permission
  • Resell, redistribute, or sublicense access to the Service without our authorization

8. Intellectual Property

Your Content: You retain all ownership rights to the debug session data you create using the Service. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

Our Property: The Service, including its software, design, trademarks, and underlying technology, is owned by Monito and protected by intellectual property laws. You may not use our intellectual property without prior written permission.

9. Third-Party Services

The Service integrates with third-party services, including:

  • Polar: Payment processing and subscription management
  • GitHub: OAuth authentication
  • Vercel Analytics: Website analytics
  • OpenAI: AI-powered features
  • SendGrid: Transactional email delivery
  • Cloudflare R2: File storage for screenshots and recordings

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

10. Payment and Subscription Terms

The Service offers paid subscription plans. Payment processing is handled by Polar. By purchasing a subscription, you agree to Polar's terms of service.

Subscriptions automatically renew unless canceled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us.

We reserve the right to change our pricing at any time. Price changes will be communicated to you in advance and will take effect at your next renewal period.

Refunds are handled on a case-by-case basis at our sole discretion. Please contact us at bartosz@monito.dev for refund requests.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONITO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any data loss will not occur.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Monito and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you capture, store, or share through the Service, including any claims of privacy violation or intellectual property infringement

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice.

You may terminate your account at any time by contacting us at bartosz@monito.dev or through your account settings.

Upon termination, your right to use the Service will immediately cease. We may retain your data as described in our Privacy Policy.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice on the Service.

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Poland.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Monito regarding the Service and supersede all prior agreements and understandings.
